LIMITATION OF LIABILITY

Robert Fawcett dba Fawcett Photography does not accept liability for any loss or additional expense caused by cancelation of the workshop or photo tour, or delay or interruption to travel services. Such losses or additional expenses are the responsibility of the participant.

Fawcett Photography and any instructors or assistants are not liable for injury, accident, or theft resulting from participation in our programs. It is the participant’s responsibility to obtain information about any risks involved. Any questions about workshop content, requirements, or risks may be directed to Fawcett Photography prior to the time of registration.

FORCE MAJEURE

For purposes of the terms & conditions described in this document, Force Majeure shall mean a cause or event such as; war or the threat of war, protests, riots, terrorist activity, civil strife, governmental acts, industrial disputes, labor strikes, injunctions, natural disasters, nuclear disaster, fire, wildfire, plague, epidemic, pandemic, outbreaks of infectious disease or any other public health crisis, including quarantine or other employee restrictions, or unfavorable or adverse weather conditions that are not reasonably foreseeable or otherwise caused by or under the control of Fawcett Photography. Any delay or failure in the performance by Fawcett Photography shall be excused if and to the extent caused by the occurrence of a Force Majeure. If a workshop must be postponed or cut short due to forces outside of the control of Fawcett Photography, there will be no refunds given.

PRICING & PAYMENT

Workshop registrations are accepted on a first-come, first-served basis. All workshop pricing is in U.S. dollars. All tickets/fees may be purchased with a credit card via Eventbrite. All fees stated are for workshop tuition only and do not include airfares, transportation, meals, film, and processing, or guide or instructor gratuities unless otherwise noted.

A non-refundable ticket, the amount will be specified in the workshop information, is required at the time of your registration. Reservations for workshops cannot be held without a ticket.

WITHDRAWAL & REFUND POLICY

All workshop withdrawal requests by the workshop participant must be in writing and received via e-mail and acknowledged by Fawcett Photography. There are NO EXCEPTIONS TO THIS POLICY, even for medical emergencies.

PLEASE NOTE that payments can be applied to other workshops or services within 365 days of original workshop. See below for further details.

· *COVID RELATED: If the workshop needs to be rescheduled due to Covid related reasons or the client is unable to attend for Covid related reasons, the client will be rebooked for the following year's corresponding workshop and those funds will automatically be applied to that reservation. If the client wishes to use the funds for another workshop or other services, this is also another option and they will need to notify Fawcett Photography of this request. Funds must be applied to workshop that takes place within 365 days of original workshop.

· NON COVID RELATED CANCELLATIONS BY CLIENTS: If the client is unable to attend the workshop for their own personal emergency, funds may be applied to other services provided or another workshop within 365 days of original workshop and this decision is granted with the sole discretion of Fawcett Photography.

CANCELLATION POLICY

Fawcett Photography reserves the right to alter or cancel any workshop for any reason. In the unlikely event that we need to cancel a workshop, we will refund all monies paid, in full, or you have the option of receiving a credit in the amount of the workshop fee that may be applied in full to pay for a future workshop to be used within 12 months of the original workshop you are registered to participate in. Fawcett Photography cannot be responsible for any travel expenses or non-refundable purchases, deposits, or reservations. It is recommended that you purchase trip insurance.

Notification of cancellation by Fawcett Photography will be made via either a telephone call or an e-mail to you. We cannot be responsible for voicemail messages and e-mails not being received in a timely matter due to your service provider(s).

TRAVEL INSURANCE

It is highly recommended you purchase travel insurance for your workshop and travel expenses. Many travel insurance providers offer products that do more than protect the money you invest in your trip — they protect you in unforeseen circumstances. We suggest a plan which offers coverage for medical and dental emergencies, lost baggage, missed connections, and trip cancellation should you have a medical problem that prevents you from attending. Fawcett Photography is not responsible for cancellations due to medical emergencies or for reimbursement of non-refundable airline tickets in the event of a workshop cancellation.

Many of our clients have purchased travel insurance through Travelex Insurance Services or SquareMouth Insurance.

NOT INCLUDED

Air transportation and related fees (except as indicated in the itinerary); activities noted as optional in the itinerary; gratuities, unless otherwise noted on the itinerary page; passport and visa expenses; baggage/accident/cancellation insurance; personal expenses, such as laundry, telephone calls, meals (except as indicated on the itinerary) alcoholic beverages; and any other items not explicitly noted as included. Transportation and National Park entrance fees are not included in your workshop unless otherwise specified or agreed upon in writing.

LODGING

The private workshop fee does not cover the cost of lodging. Please make your reservations as early as possible to ensure you have acceptable accommodations during your visit.

Cost increases for lodging may occur unexpectedly due to rising costs of accommodations, among others.

EQUIPMENT

Fawcett Photography does not provide equipment of any kind for use by workshop participants. Workshop participants must provide their own photography gear and (if needed) a laptop computer.

PARTICIPANT HEALTH & PHYSICAL FITNESS

Fawcett Photography workshops are within the abilities of average people in good health. We ask that you please contact us if you have any questions or concerns about the activity levels of the workshops. Some workshops require the ability to walk or hike a few miles over uneven trails, while also carrying your photo gear. By reserving a space in a workshop with a deposit, you certify that you do not knowingly have any physical or other conditions of disability that would create a risk for you or other workshop participants or workshop staff. Once your workshop payment has been made, medical circumstances will not be considered as exceptions to our cancellation policy. We assume no responsibility for medical care or special dietary requirements.

RESPONSIBILITY OF WORKSHOP PARTICIPANTS: SUBSTANCE-FREE ENVIRONMENT

It is expected that all participants act in a polite and law-abiding manner. Any illegal activity, drunkenness, illegal drug use, poor treatment of other Workshop participants or Instructors, and disrespect will not be tolerated. We reserve the right to send participants home early at their expense if they cannot comply with these expectations.

ADHERENCE TO OUR COVID-19 ADDENDUM

In accordance with the current policies and regulations of the National Park Service, Fawcett Photography will be following Covid Protocols set forth by National Park Service.

ACKNOWLEDGEMENT OF RISK:

FAWCETT Photography carries the necessary permits, First Aid / CPR Certification and Liability Insurance for legal operation. Each Workshop participant understands and acknowledges that your travel may involve risk and potential exposure to injury and possibly death. Risk and dangers may arise from foreseeable and unforeseeable causes. The participant fully understands and acknowledges that the risks, dangers and hazards are a potential in connection with your travel and recreational activities which may take place during your journey.

By paying the workshop ticket, you are agreeing to accept all the above terms & conditions.
